This afternoon the police will be recording a Section 112 Criminal Procedure Code (CPC) statement from me under Section 9 (5) of the Peaceful Assembly Act 2012 for organising/participating in an International Habitat Day gathering at Parliament on Oct 8, 2019.

KUALA LUMPUR – 8 NOVEMBER 2019: S. Arutchelvan, Timbalan Pengerusi Parti Sosialis Malaysia (PSM), telah dipanggil polis untuk rakaman percakapan berkenaan dengan aksi perhimpunan Hari Habitat yang diadakan di hadapan Bangunan Parlimen pada 8 Oktober 2019 yang lalu. Arutchelvan telah disiasat di bawah Seksyen 9(5) Akta Perhimpunan Aman 2012. Arutchelvan hadir ke Ibupejabat Polis Daerah Dang Wangi pada hari ini untuk diambil keterangan oleh polis. Aksi sambutan Hari Habitat merupakan program tahunan seperti sambutan Hari Pekerja dan Hari Bumi. Tahun ini, PSM bersama dengan Gabungan Peneroka Bandar dan Perumahan mengetengahkan isu pengusiran dalam aksi Hari Habitat tahun ini. Menurut Arutchelvan, “Aksi tahun ini berjalan dengan lancar. Kami diiringi polis yang mengawal lalu-lintas dari Tugu Negara hingga ke jalan di hadapan Parlimen. Beberapa orang Ahli Parlimen menyambut kami dan satu delegasi masuk ke dalam untuk menyerahkan satu memorandum kepada wakil Menteri Perumahan dan Kerajaan Tempatan. Seperti biasa adanya laungan slogan, barisan piket, pengambilan foto dan ucapan. Suasana sangat aman.” “Ini bukannya satu serbuan atau flash mob di luar Bangunan Parlimen. Kami telah menyerahkan pemberitahuan 10 hari seperti biasa kepada polis. Kami mengadakan perbincangan dengan polis mengenai laluan perjalanan kami dan sebagainya. Semuanya berjalan lancar tanpa kejadian yang tidak diingini,” ulas Arutchelvan. “Jadi, kenapa polis panggil saya untuk siasatan? Bukankah ini membazir masa dan tenaga polis?” tanya Arutchelvan. “Jika aduan polis ini dibuat oleh orang awam kerana tindakan kami menimbulkan gangguan, saya akan faham kenapa pihak polis mahu melakukan penyiasatan. Tetapi di sini adalah polis sendiri yang membuat aduan untuk memulakan siasatan. “ “Satu lagi perkara, jika ini hanya satu formaliti di mana polis perlu mengambil kenyataan, maka hanya perlu panggil orang yang namanya terdapat dalam surat pemberitahuan. Tetapi hakikatnya bukan begitu pula. Ini kerana peguam saya Shashi Devan dan Setiausaha Agung PSM A. Sivarajan telah diberitahu bahawa pihak polis hendak mengambil rakaman percakapan untuk 8 orang lagi, termasuk Ahli Jawatankuasa Pusat PSM, pemimpin Pemuda PSM, pemimpin komuniti dan pemimpin Jaringan Rakyat Tertindas (JERIT). Kebanyakan mereka yang dikehendaki rakaman percakapan adalah sama ada mereka yang merupakan perwakilan yang masuk ke Parlimen untuk menyerah memorandum atau mereka yang berucap di hadapan peserta aksi. Pendek kata, pihak polis membuat aduan polis mereka sendiri, kemudian mengeluarkan notis di bawah Seksyen 111 Kanun Acara Jenayah dan mengambil rakaman percakapan daripada 9 orang, hanya kerana satu aksi yang tidak berlaku apa-apa perkara yang tidak diingini. Jadi, adakah polis mempunyai begitu banyak masa lapang untuk kerja sebegini?” ulas Arutchelvan. Baru-baru ini, didapati pihak polis menghabiskan lebih masa dalam menyiasat aktivis atau peniup wisel, berbanding dengan suspek jenayah. Baru semalam, jurucakap NGO Rakyat Bantah Penghilangan Paksa (CAGED) Rama Ramanathan dipanggil untuk siasatan polis di bawah Seksyen 504 Kanun Keseksaan dan Seksyen 233 Akta Suruhanjaya Komunikasi dan Multimedia Malaysia; malah polis menggeledah rumahnya tanpa waran untuk merampas komput berkata er dan telefon bimbitnya sedangkan polis boleh meminta Rama untuk menyerahkan sendiri barang yang dikehendaki itu. Adalah tidak masuk akal untuk membuat drama sedemikian. Komen tentang insiden salahguna kuasa polis sebegini, Arutchelvan, “Kasihan kepada pasukan polis yang dibebankan dengan tugasan sebegini. Suaram accuses cops of wrongful arrest, torture of suspects

The rights group says the police failed to conduct investigations before making the arrests in Kangar last month. KUALA LUMPUR:  Rights group Suaram today accused the police in Kangar of arresting a father and son whom it said were wrongfully detained, tortured and held for four days without bail. Suaram executive director Sevan Doraisamy said Pukalanthee Rajoo and Linggeswaran Pukalanthee were arrested on Sept 21 and released on Sept 25. He also claimed the two were tortured in custody and accused the police of failing to conduct initial investigations before making the arrests. According to Pukalanthee and Linggeswaran, who were present at the Suaram press conference here today, they were hired on contract to tar roads in a residential area and had rented a car for this purpose. They said they were told that a girl had found their movements around the area suspicious and lodged a police report with the help of a neighbour. They said the police contacted the car rental agency and “lured” them to a specific location where they were “ambushed” by heavily armed officers. It was not until the second day of their arrest that they were told why they were detained, they said. Father and son duo Pukalanthee Rajoo and Linggeswaran Pukalanthee at the Suaram press conference today. Both of them denied ever meeting a girl. Suaram’s legal adviser Shashi Devan said both father and son had since lost all their job contracts. “They don’t have a job, no one speaks to them anymore. We would like to stress the importance of the Independent Police Complaints and Misconduct Commission, especially when arrests are made before investigations and when there is abuse in custody. PSM: Probe on gathering unnecessary and waste of public resources

The gathering was held on April 1 outside Kajang Prison to support student held under security laws for having books related to terrorism. KAJANG: Parti Sosialis Malaysia (PSM) central committee member S Arutchelvan today criticised police for investigating a peaceful solidarity gathering held for former Master’s student Siti Noor Aishah Atam outside the Women’s Prison here two months ago. “Police calling me today to investigate (the gathering) is unnecessary and a waste of public resources. This is a public gathering and I believe police had gathered evidence in the form of pictures and videos,he told reporters at the police district headquarters. Arutchelvan and his lawyer, Shashi Devan, spent about 15 minutes in the police station having his statement recorded by investigating officer Insp Raziman Rasid after he received a letter dated June 9 asking him to be present at the police station today. It was reported that about 30 people had gathered in front of Kajang Prison on April’s Fool Day to show solidarity with the former Universiti Malaya student, who was arrested under security laws. Besides Arutchelvan, Bersih 2.0 chairperson Maria Chin Abdullah and Suaram activist Amir Abd Hadi were also said to be present. On April 26, Siti Aishah was jailed five years by the High Court for possessing 12 books related to terrorism. Previously, the same court acquitted her on the charge of possessing the books on terrorism in September 2016 but the appeals court overturned her acquittal and ordered her to enter her defence on the charge. Arutchelvan also told reporters that he had told Insp Raziman he would only answer questions about the gathering when he is charged in court. He also told police his views that every Malaysian had the right to assemble peacefully under the law. Arutchelvan was in the past hauled up for investigations for various offences. Last year, he was picked up for investigations for organising a Labour Day rally and arrested a day before the Bersih 5 rally. He also faces a sedition charge for allegedly criticising the judiciary over the Sodomy 2 decision against opposition leader Anwar Ibrahim in 2015. Credit : Free Malaysia Today
